Once a bulk carrier completes cargo discharge, one operational question arises before hold cleaning can begin. Can the holds be washed at sea, or must residues be retained for disposal ashore?
The answer depends on the type of cargo previously carried, the vessel’s geographic position, proximity to designated Special Areas, and the classification of cargo residues under international environmental law. Getting this assessment right is routine voyage planning. Getting it wrong carries consequences ranging from substantial financial penalties to criminal prosecution of individual officers.
The Rule That Governs Nearly Every Voyage
MARPOL Annex V entered into force in 1988 and underwent significant revision in 2013. Its operating principle is clear: all garbage discharge into the sea is prohibited unless specifically permitted under the regulation’s defined exceptions.
The single most important classification within this framework is the distinction between cargo residues that are Harmful to the Marine Environment, known as HME, and those that are not. This classification determines the discharge options available, and in many cases, whether sea discharge is permitted at all.
Substances are classified as HME if they are identified as marine pollutants in the IMDG Code, or if they meet specific scientific criteria related to bioaccumulation and aquatic toxicity.
A Decision Made on Almost Every Voyage
For anyone involved in bulk carrier operations, Annex V is not background regulation. It is the rulebook that governs a decision made routinely, quietly, and with real legal weight behind it.
Understanding these rules protects the marine environment from pollution by cargo residues, and it protects the vessel, its officers and its operating company from the legal, financial and reputational consequences of getting the classification wrong.
